1. Scope and provider

These Terms of Use govern the use of the Parcourse app (hereinafter “the app”) between you and:

By using the app you accept these terms. Our Privacy Policy applies in addition.

2. Minimum age

The app is intended for people aged 16 and over.

You can use the workout, camera and map features without an account and without sharing data. Features that make content visible to other users — public name, friends list, leaderboards, station reviews, location sharing — require consent and are therefore only available from the age of 16 (Art. 8 GDPR).

3. Right of use

We grant you a simple, non-transferable, revocable right to use the app on devices you control for private, non-commercial purposes.

The following in particular are not permitted: reverse engineering, decrypting or decompiling the app, circumventing technical protection measures, automated bulk queries, and manipulating leaderboards, repetition counters or competition results.

4. User content — no tolerance for abuse

You can create content that other users see: station reviews, your display name, your public name (@handle) and entries in leaderboards. You are responsible for this content.

We do not tolerate offensive content or abusive behaviour. The following in particular are prohibited:

  • Insults, threats, harassment or bullying
  • Incitement to hatred, racist, sexist or otherwise discriminatory content
  • Sexually explicit content or content glorifying violence
  • Spam, advertising and misleading statements
  • Content that infringes third-party rights (copyright, trade mark, personality rights)
  • Impersonating another identity

Reporting: any visible content from others can be reported via the context menu. Blocking: you can block individual users; their content is then no longer shown to you. You manage blocks under Settings → Blocked users.

Our commitment: we review reported content within 24 hours. If content violates these terms, we remove it and block the responsible account. In the case of serious or repeated violations, we block the account permanently and without prior notice.

5. Health notice

The app is a training and motivation tool. It is not a medical device and replaces neither medical advice nor a diagnosis or treatment.

Camera-based movement analysis provides approximate values and may contain errors. Train only within your physical capabilities, stop if you feel pain, and clarify health risks with a doctor beforehand. Training on public sports equipment is at your own risk; pay attention to your surroundings, especially when running in traffic.

6. Availability

The app is in a beta phase. We endeavour to provide stable operation, but do not owe uninterrupted availability. Features may change, be added or be discontinued.

Map, station and weather data partly originate from third parties (including OpenStreetMap) and may be incomplete or out of date.

7. Liability

We are liable without limitation for intent and gross negligence, as well as for damages arising from injury to life, body or health.

In the case of simple negligence we are liable only for the breach of a material contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), and limited in amount to the foreseeable damage typical for this type of contract.

Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

8. Termination

You can stop using the app at any time and delete your account in the app (Profile → Delete account). Upon deletion we remove your personal data in accordance with the Privacy Policy.

We may block your use if you violate these terms — in particular section 4.

9. Changes to these terms

We may change these terms, for example in the case of new features or a changed legal situation. We will inform you about material changes in the app and, where necessary, obtain your renewed consent. The version displayed in the app at the time is authoritative.

10. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
